Terms and Conditions
These terms and conditions apply to all offers, orders, and agreements of BoekjesAtelier.
Article 1 - Definitions
In these terms, the following definitions apply:
- BoekjesAtelier: the sole proprietorship BoekjesAtelier, based in Houten, registered with the Dutch Chamber of Commerce under number 99671220.
- Customer: any natural person or legal entity who places an order through the website.
- Product: the personalized children's book custom-made by BoekjesAtelier.
- Agreement: the agreement between BoekjesAtelier and the customer.
Article 2 - Applicability
These terms and conditions apply to all offers, orders, and agreements of BoekjesAtelier. Deviations from these terms are valid only if agreed in writing. By placing an order, the customer declares that they have taken note of these terms and agree to them.
Article 3 - Formation of the agreement
The agreement is formed at the moment the customer places an order and the payment has been processed successfully. After placing the order, the customer receives a confirmation by email.
Article 4 - The product
All products of BoekjesAtelier are specially custom-made based on the information and choices provided by the customer. The preview gives as realistic an impression as possible of the final product. Minor deviations in color, print quality, or positioning may occur.
- The customer is responsible for the accuracy of the entered information, such as name, spelling, and date of birth.
- The customer is responsible for carefully reviewing the preview shown before placing the final order.
Article 5 - Prices and payment
All prices are in euros and include VAT, unless stated otherwise. Shipping costs are shown separately during the ordering process. Payment takes place through the payment methods offered on the website (via Stripe). BoekjesAtelier reserves the right to change prices. Price changes do not affect orders already placed.
Article 6 - Delivery
The stated delivery times are indicative. BoekjesAtelier is not liable for delays outside its reasonable control. This does not affect the customer's statutory rights. Delivery takes place at the address provided by the customer.
Article 7 - Right of withdrawal and returns
Because the product is fully personalized, the right of withdrawal is excluded in accordance with article 6:230p sub f of the Dutch Civil Code. Returns or cancellations are not possible after the order has been completed, unless there is a demonstrable production defect.
Article 8 - Complaints
Complaints must be reported in writing within a reasonable time after discovery via info@boekjesatelier.nl. BoekjesAtelier will assess the complaint as soon as possible and, if well-founded, offer an appropriate solution.
Article 9 - Liability
BoekjesAtelier warrants that the product corresponds to the preview approved by the customer. The customer is responsible for carefully reviewing the preview before completing the order. BoekjesAtelier is not liable for errors, inaccuracies, or unwanted wording that were visible in the preview and approved by the customer. BoekjesAtelier is not liable for indirect damage, consequential damage, or non-material damage. Any liability is limited to the amount paid by the customer for the relevant product, unless there is intent or deliberate recklessness. The book is composed with the help of automated systems (AI). Minor subjective differences in style, tone, or interpretation do not constitute a defect, as long as the product corresponds to the approved preview. If there is an evident technical error, such as missing pages or damaged print, BoekjesAtelier will offer an appropriate solution free of charge.
Article 10 - Intellectual property
All books of BoekjesAtelier are custom-made with the help of automated systems (AI). The customer receives a non-commercial right of use for personal use of the book. BoekjesAtelier retains all rights to the underlying technology, templates, story structures, and systems and may continue to use and develop them. Any use of output for demonstration or promotion will take place only in anonymized form, without traceable personal data or photos of the child, unless explicit permission has been obtained.
- It is not permitted to commercially exploit the book or parts of it, such as sale or redistribution.
- It is not permitted to use the book or parts of it for promotional or commercial purposes without prior written permission from BoekjesAtelier.
Article 11 - Misuse and inappropriate content
It is not permitted to upload inappropriate, misleading, or unlawful content. BoekjesAtelier reserves the right to refuse or cancel orders in cases of misuse or breach of these terms.
Article 12 - Privacy
BoekjesAtelier processes personal data in accordance with applicable privacy legislation (GDPR). Personal data is used solely for the performance of the agreement. Further information about the processing of personal data is included in the privacy policy on the website.
Article 13 - Governing law
These terms and conditions are governed by Dutch law.
